Question for ya's
« on: June 13, 2005, 12:53:14 PM »
Was just wondering, do you guys know a lot about the legalities of remaking a game?  Curious because apparently this site ran into legal troubles.  Was wondering if anyone knew if this was illegal or not?

We're fully aware of the legalities of this game.  You can find out more specific legal information on our Legal page.  Also, since we're making an unofficial sequel and not a remake, the ratio of copywritten content to original content is extremely small.

Given that and the fact that AGDI negotiated an agreement with Vivendi Univeral after having remade KQ1VGA and KQ2VGA, we feel that the chance of our game running into legal troubles is slim to none. :)

I think difference here is that the Sierra company has NO interest in KQ and that KQ as far as they are concered is dead and gone. Not so here obivously :):):)

Chronotrigger is still an active game with Sqauresoft now Sqaure-Enix, they might be done making Chrono games however it is still very easy to get one of the Chrono games from them. So they may not want ppl doing their own remakes of that game. Whereas with KQ and other Sierra titles it really doesn't matter so long as no one is profiting from the remakes.

Basically because we were developing a "King's Quest" game without their permission.

But to go back to what the original poster was asking, I now don't believe a remake is any more or less illegal than a sequel.  I've seen people argue both sides of the issue claiming one is less risky than the other.  The fact remains that when you don't have permission from the copyright owners, you are taking a huge risk.
