This may sound like a silly question, but it is not intended to be one. Obviously, the name Phoenix Online Studios refers to the legend of the Phoenix rising from the ashes, paralleling your plans for KQIX. However, it occurred to me that there could easily be a software company based in Phoenix AZ with the same name or something similar. Have you investigated this possibility?
Once the votes are read, the decision is final. The person voted out will be asked to leave the Tribal Council area immediately. I'll read the votes...

Yonkey

I don't believe there is another Phoenix Online Studios.  But if you find one, let us know. :P
"A wish changes nothing. A decision changes everything."

Say

Yes, there is actually but not exactly "Phoenix Online Studios" I think it's "Phoenix Studios" and they haven't even fully completed their website anyhow, if, they're currently producing anything at all so far.

Truth is, there are over more than whatever I could possibly know "phoenix" companies names, the name story (why that name was chosen) is truly a loooong story.

Pheonix Online "KQ9" is a group of people who are making an "Officcial KQ Game" with an "Original Story Line" with "Original Characters" They are a "Company" that tries to make an elligal product under their own Logo name.

They should've in the first place change their Brand/Logo to Sierra something or Vivendi something or just say "King's Quest 9 - Every Cloak Has A Silver Lining" They tried to "In Vivendi's eyes" sell KQ9.

AGDI had a "good to go" from Vivendi themselves with the Quest For Glory 2 VGA, because they are remaking old games with new graphics. They are safe, because they are fan people with a fan website and Vivendi could see these people are alright and are not trying to make a brand new game in their own Logo Name.

There is a Website witch is named "Project Katrina" and doesent have their own brand Logo name, they are safe.

I can go on and on with other Fan Sites that are making and remaking Games and they are safe, because they are just Fan projects.

Vivendi thinks "Pheonix Online" are a Company that tries to steal a Sierra brand and then tell them "We can do better then VU"

It's not because of the Trailer or the 4 year hard work, its what they saw after the Trailer and on your Site.

In the future, Phoenix Online Studios will branch out to create bigger and better games, possibly even going outside the realm of adventure. We are currently looking at several different ideas for other games to work on, although nothing has solidified yet. Each game will have a distinctly different team and their individual styles will show in the end product, however the same high quality of work will be maintained throughout each to create awesome games every time.

This Site has mini Games, Media, Maps,
everything to start a "small company of your own in secret"

Say and Cesar, tell Vivendi that you guys are only making a KQ9 Game for the Fans, because KQ8 was an Action Game and it did not had the conlusion that we so hoped for. Tell them that Roberta Williams and Ken Williams supported the KQ9 Team and that they were proud of your work. Show them pictures and half of the Game. Apologize to them and Delete your Pheonix Online "Brand, Company, Whatever" and make all 3 Chapters of KQ9 with the Soundtrack "i read somewhere" and give the whole thing to Vivendi and ask them to sell KQ9 with the KQ Compilation and tell them it would be very good Bussiness for them and they are gonna make allot of Money.

Daventry says:
Pretend you have a farm with horses and you sell them and your farm is called horse for sale. Your Logo is yellow, the papers are blue and you have logos on your trucks, but you see another person that you dont know has the exact same farm, exact same truck with logo and all and does the same bussiness then you, but they have a diffrnet telephone number and their name say's horse to buy, what would you do.

Jason says:
I would sue

Daventry says:
Exactly my point, Vivendi sees a Fan based Game witch is under their name even though they dont make Sierra Games no more, they see but these people are Pheonix and are trying to make profit from our bussiness, so they shut down the KQ9 project, but decide not to sue.

Jason says:
yeah but Phoenix isn't the same case, they have a different name and they don't fool fans into believing they are Vivendi.

Daventry says:
Diffrnet name, same Sierra Product, but Vivendi thinks we are trying to fool them.

Jason says:
yeah but with the horse thing, it was everything but the phone number that was the same

Daventry says:
i see

Jason says:
Phoenix don't have the same site, same company name, same logo colours and they don't even use the traditional KQ logo, so I just think there is another reason, but everyone has their own opinion and that does make sense.

Daventry says:
They're maybe another reason and they don't have to have the same everything as VU, but they are making a Sierra Product "in secret" so to speak and VU caught them.

Jason says:
yeah because they had only notified the last people that owned the KQIX rights.

Daventry says:
who notified what last people of the KQ9 rights.

Jason says:
Not sure, but Neil mentioned it previously in the Shut Down thread.

Say

I don't think that'd be the right way to go, specially because that's not how things are supposed to be, and specially not in this very particular moment, we already are who we are, we already got the C&D letter and that's all I can speak about this so far.

I also believe you're asuming far too much, this is not a matter of doing things under their own logo, actually, it's just a matter of IP, it's just not the same, we're not trying to be either best or bigger than VU (we're simply NOT) we're also not even trying to pretend to be them, it's the fact that we based our whole "whatever new story" with THEIR IP, this by no means involves corporative image but copyrights.

And this has absolutly nothing to do what Phoenix is about, Phoenix might have worked on this and might have commited truly to this development, but this is just a start, not all of it, so obviously your asumption of that you highlighted in red and took out of context, is just that I believe, out of context.

I see your point Daventry; I even understand what you are implying perfectly.

But do you really think they would have sat and made no fuss, if the name "Phoenix.." didn't appear, at all, in the first place? Most of the observations you made, are answered by your own remarks.

You never know what the future holds, Cesar isn't the kind of person that gives up easily, nor the rest of the KQ9 team; as they have proven in the past.

Dean

daventry

Why did Cesar or Say never Contact VU in the first place and explain to them about KQ9, instead of going through 4 years in making a very cool Game hoping they dont get caught and now everyone is angry at VU for shutting down KQ9.

Please save all discussion concerning the project shut down to the correct thread.
