Well, it's stated on like very page that all the stuff is copyright Sierra, so at least THAT copyright law is being respected here.  

In America, EVERYBODY sues for dumb things.  Like that woman who got how many million from McDonalds for have hot coffee spilled in her lap (this just in, coffee is HOT!).  If you break into someones house and get injued, you can actually sue the owner of the house, even though YOU invaded.  And even sicker, some of these people actually win!

It's true that it's not only in America, but America is a capitalist country that cares more about the rights of mega-corporations than about those of it's private citizens. That's why it's more concerned about copyright violation - as it was in the case of "Napster", which american courts closed down while "Kaaza" won a similar lawsuit against them, that was filed in Denmark (I'm not sure about the country... it was europe, anyway).

Maybe the reason sierra don't sue you is because vivendi is french?   ;D

Forget it. Sierra legal had our URL earlier, but simply didn't tell their superiors at Vivendi legal about it. They didn't find out about us until later. (it's not like Vivendi's interested in puny fan-groups. Both Sierra and Vivendi have more important things on their mind)

Nationality is irrelevant when it comes to international laws. Vivendi legal or Sierra legal no doubt made a little investigation and came to the conclusions there were no real reasons to worry. The situation is not just one of copyright infringement, it's a phenomenon the existing fanbase greatly support.

Well, as long as the fan-made game sdon't try to make money out of their games, I see no reason why they cannot produce Sierra games. We are actually doing sierra a favor by continue their series and thus promoting their games.

Since you seem to be the Tierra link here, can you please tell me why I didn't get an answer for my application for a beta tester on the KQ2 remake?  ??? ??? ???

Sorry, Storm, but the beta tester recruitment was a very hectic period for me. There was quite a list of volunteers and assembling the teams was already quite a job for me.

After the AGD's made the final say on the teams, I contacted every selected person and informed them they were chosen as well as telling them what was expected from them. The testers were required to accept their task and then I'd give them the password to our private testing forums. After they made a post in the introduction thread there (confirming that they were able to access and post in that folder) I started sending them the link to KQ2VGA's beta version. (since Tom's server couldn't handle lots of traffic, a download schedule had to be created) That basically meant I had to remain in close contact with all the testers (all 19 of 'em, although not everyone made it to the credits section) and ensure that everything went smoothly.

Since the point list technical testers received was kinda limited, I also started working on a FAQ (it's already over 50 pages now) while giving hints to testers who got stuck in the meantime. I also did as much testing and reporting as the most active testers myself, so it's definitely been a busy time for me.

Because of all this, I didn't get around to contacting all the applicants who weren't chosen. After closing the application, I DID mention that if my mail wasn't in your mailbox by now, you weren't selected. I assumed most people read that post as well. (although I might be wrong)

So I'll admit that it might have been more polite to also inform those who weren't chosen, but I was more concerned with the smooth start of the testing process than with handling the formalities.

Don't worry, I forgive you ;D. Still, it would have been nice to get at least a rejection by e-mail. I didn't get one from this place, but I guess it's because they don't bother sending rejections notices either  :(.

You might have preferred a rejection through email, but other people might be annoyed by a pesky beta supervisor contacting them and "rubbing it in their face". And I have no idea how everyone would feel about it. (but I can imagine opinions differ on the issue)

As for the fact that you weren't chosen, there were quite a few applications and I had to make selections. (I merely make team suggestions, the AGD's fiddled around a bit with the suggestions and compared them to their own ideas, although teams remained fairly close to my original planning)

When looking back on the whole thing, it's a pity there were still some drop-outs. Either people who took the first version and ran or people who were suddenly bombarded with unexpected things. Those places could have been filled, but you never know completely sure if someone will make a good tester or not.

Oh well....
