Title: Form Letter for Contacting Gaming Websites

In greater thought about my suggestion about contacting gaming websites and letting them know about the situation, I have come up with the following letter which you can copy and paste when submitting to gaming websites:

BEGIN LETTER

Earlier today (February 28th), Activision issued a Cease and Desist order against fan developer Phoenix Online Studios, who has been hard at work on The Silver Lining, an unofficial sequel to the venerable King's Quest series.

Visitors to the game's website, located at http://www.tsl-game.com are now greeted with the following letter from the development team:

To Our Fans:

In 2005, Phoenix Online Studios received a Cease & Desist letter from Vivendi Universal, the owners of the King's Quest IP, in regards to our work on The Silver Lining. We complied with the request, and over the months that followed, we were able to work out a non-commercial fan license with Vivendi that allowed us to continue our work on the game.

We have spent a lot of time recently reworking the material of The Silver Lining into episodic releases, with the first out of a planned five episodes completed, and submitted for review, and had hoped we would be able to bring our game to you, the fans, in the Spring of 2010.

Recently, however, ownership of the Sierra IP changed hands and became the property of Activision. After talks and negotiations in the last few months between ourselves and Activision, they have reached the decision that they are not interested in granting a non-commercial license to The Silver Lining, and have asked that we cease production and take down all related materials on our website.

As before, we must and will comply with this decision, as much as we may wish we could do otherwise.

We cannot say enough how much we appreciate the support we have had over these years from our fans. Without you, we would never have gotten this far. There would be no game to develop, and no one to develop it for. You have been amazing and steadfast, and we will always remember that and appreciate it more than we can say.

Sadly, after eight years of dedicated work and even more dedicated fans, The Silver Lining project is closing down.

What the future holds for us, as individuals or a team, we cannot say. We have an amazing development team, however, filled with talented and hard-working individuals, and we hope the teamwork and rapport we have developed will not go to waste. We hope that when we do know what the future holds for us, our fans will be there to enjoy what we can give them still.

Again, thank you all so much for everything. This has been a long and crazy road, full of more twists than we could have anticipated, but more triumphs and wonderful memories than we could have ever hoped for. And for that, to all of you and to everyone on our team, we will always be grateful.

As many of you will recall, back in 2005, Phoenix Online Studios was issued a Cease and Desist by Vivendi Universal for the development of King's Quest IX. After a lengthy petition and review process, Vivendi Universal granted the developer a limited non-commercial license to develop their game, which was renamed "The Silver Lining".

However, with Activision's recent acquisition of Viviendi Universal's properties, the fate of The Silver Lining came into question yet again. Today that fate appears to be sealed. The Cease and Desist issued by Activision calls for the immediate cease in production of the game as well as taking down all related materials from the game's website. At this time, the game website has been taken down and the bulk of the game's community forums has been taken down by the development team in an attempt to comply with the order (though efforts are being made to go through the forum in greater detail to comply with the order and put back into place any parts of the forum that do not directly pertain to the game).

The Silver Lining began it's development in 2002 and despite many challenges and hurdles, was on track for a summer 2010 release.  A petition is available online at http://www.petitionspot.com/petitions/savetsl/ which is petitioning Activision Publishing, Inc. to retract the Cease and Desist order and allow The Silver Lining to finish development and be submitted to Activision for an impartial review to ensure standards in quality and content.

Just copy and paste this for submission to any gaming website you regularly visit (most websites these days have a "Submit News" or "Submit a Tip" link somewhere on their site).

I saw another article online earlier.  It just makes it seem more real.  How sad.  :'(

Nice job on the letter, by the way.  I don't really frequesnt any gaming sites, but I'll keep it in mind next time I'm lurking on a gaming forum.

The only people I've seen on Activision's side don't have all the facts so they're clearly not reading the articles, they're just commenting to be morons. :P That's like...three people that I've seen. :P

Yeah, most everyone else has been on our side. I've read a few that go for activision, but most comments are making fun of the company.

Among the many sites I have submitted the letter to... I have also submitted the letter to G4TV.com (specifically, the X-PLAY section), which runs on TV.  I don't have cable or satellite (due to not watching much TV).... but you all might want to keep an eye on the shows X-PLAY and ATTACK OF THE SHOW for mention of this on tv...

I hope they list it there! That'd be great. I would say Attack of the Show is more likely to give us a chance in the spotlight over X-Play, but I wouldn't know for sure. I do like G4TV. It's a great channel, and they have some awesome E3 coverage...

Yea definitely.  You never know about X-PLAY though.... Adam and Morgan are both definitely gamers... but then again so is Ollivia and the other host of ATTACK OF THE SHOW.... so who knows.

I also found a link to an article over at GameInformer, which is the website portion of GameStop's magazine... so there's a very strong chance it'll be in print at some point.

I don't know if it'll even faze them, but I just shot an email to Ken and Roberta Williams.  I also sent them a link to your petition, oberonqa.  I know that, since they sold Sierra, they have no rights to it anymore, but I thought they might like to know anyway.

I would like to point out the article over at GameInformer does have a screenshot of the game I had not seen previously.... a shot of Graham sitting in what appears to be Charon's boat crossing the River Styx with someone standing in the boat behind him and Charon at the head of the boat steering it.  

I don't recognize this screenshot...

Unfortunately, I don't think so. Believe me, it would be amazing if they did, but I have the feeling they don't.

Also, from what I've been gathering, Ken and Roberta are presently sailing around Japan, and may not have internet access. I prey that they do and that they can do something about this, but I don't know that they can.

It looks like the screenshot is from one of the earlier builds of the game. From way before the original Cease and Desist.

Signature #211 is from Ken Williams (email verified) and the signature is from user account KenWilliams864, an account that was registered in March 2010 (today).

I'll see if there's any reference to his support of this petition on his website and if there isn't... I'll probably delete the signature.

I mentioned the Roberta and Ken in the original thread and someone stated that they were in the chat earlier supporting the team. So is this it for now? Has POS said anything or are they just trying to get their heads together after this stupid turn of events. I guess the last option would be hope Activision at some point sells the Kings Quest IP. Man I was expecting any day release information, and this is what we get instead.

Just wanted to say that news about the Silver Lining is showing up in blogs in many languages.  Just finished looking at an article on an Italian game blog.  I'll keep word about the petition going.  Also, any word on this being the true Ken Williams yet?

As a side note, I have recently starting prowling through the other fan-developer forums to keep an eye on things.  There appears to be a great deal of concern over at AGDI that they may get caught up in things here.  While I have made a post on their forums assuring them we will not bring them or any other fan-developer into the movement, I would like to ask that we refrain from mentioning other groups successes.  

It's one thing to point out AGDI's impact on the sales of KQ Collection when KQ1VGA and KQ2VGA was released (because that was back in the Vivindi days and is history at this point), but let's not dwell too much on their current doings, or the doings of any of the other fan-developers.

Thats how the forums works.  If you make a post and then make another post before someone replies to it, the forums automatically puts the two posts together.  For example:

person a
person b
percon c
person c
person a

would show up as:

person a
person b
person c | c (notice the line break)
person a

It didn't use to do that; it'd just add it as a new post and increment your post count by one. Not sure why it changed, maybe to discourage random posting just to increase post count?

Keywords 4-9 are game-based tags, targetted at people who like specific games (all of which, you'll note, are adventure games) and will be used to target people who like specific games but don't necessarily have other keywords in their profile.  Note I cannot use the keywords "The Longest Journey" (due to no entry in the list) or Sam and Max (due to the list search mechanism freezing up).  Also unable to use keywords for other Quest games (Space Quest, Police Quest, Quest for Glory, etc)

Keywords 10-13 are genre tags, targetted at people who have one (or more) of the keywords in their profile.

Keyword 14 is a creator tag, targetting people who have Roberta Williams in their profile.  I am unable to select keywords for other Sierra designers, such as Al Lowe, Lory & Corey Cole, etc.

The ad will probably be targetted at the following regions:

1. United States
2. Canada
3. United Kingdom
4. Mexico
5. Japan
6. China
7. Germany
8. France
9. Sweden
10. Spain
11. Italy
12. Austria
13. Australia
14. New Zealand

Initial reach analysis estimates the ad, given the above criteria, would reach 94,080 people. 

If I run the ad with a budget of $20 per day on a CPM (Cost per Impression) rate, given a cost of $0.28 for every 1,000 ad impressions, we would average approximately 72,000 ad impressions per day.

Conversely, if I run the ad with a budget of $20 per day on a CPC (Cost per Click) rate, given a cost of $0.53 per ad click, we would average approximately 38 clicks per day, but with unlimited ad impressions until we reached the target of 38 clicks per day.

Needless to say, I have some decisions to make and hence why I am looking for suggestions.  I currently have a budget of $60 for the campaign, which would enable me to run the ad for 3 days.  I'm leaning towards the CPM rate, because truthfully, while CPC sounds better on paper, given the limited budget, I think we stand to gain a lot more by going with CPM instead of CPC (though CPC will garner more impressions... but if we hit the target of 38 clicks in 2 hours, then the other 22 hours won't have any impressions).

I always think that going "Cost per Click" is a better deal -- it guarantees you're paying for a positive reaction and not for people who don't actually care. Yes, it puts a limit on how many people will see it, but at least you're not paying for people to go "WTF? WHY DOES FB SHOW ME THIS STUFF???" y'know?

I have found Activisions Phone number! I have not called it yet but as soon as I am out of the office I shall and tell you all if it works and how to get a hold of someone who will listen to us. I also found and interesting article dealing with EA and Activision. I play alot of EA games so I read a bit on them however then are fizzling out in my opinion and I think Activision might fall into the trap as well.

Communication between me and Activision have started. I have given them Yonkey's email address so they can contact him as well. Someone has the petitions on their desk and they have been opened! Activision knows about us and the word is spreading through the company as the representative I spoke to hear about TSL in passing.

I heard about this whole situation while watching a "Let's Play" on youtube.  If you want to spread the word further you might try commenting in the Let's Play King's Quest videos.  At leastv you'd catch the attention of people like me who like let's plays as background noise.
