What is wrong with you guys.

This is my first post, I've never felt the need to register.  About once every year I've checked here to see if this game has been completed, every year I'm disappointed.  And now, after the game has been finished, I find out you will not be releasing it because of some fascist company.  I know I have absolutely no right to say this, but I don't care, you guys are complete wimps.  10 years have gone into this game and you are throwing in the towel because of activision?!  How did you not go into this expecting it to happen!?  This is absolutely ridiculous.  Release the goddamn game already.  Who cares about them.  It was "accidentally" leaked on a torrent, or in IRC.. whups.  I mean come on, be a man and just release it.  At least change all the names with a simple word replacement script so it's not related to KQ at all and then release a script on the net from obscure hard to find locations that puts them all back.  It's really not all that complicated.  Hell, give me the game, and I'll make sure it gets out to the public without being linked to you guys at all.  God it makes me sick to my stomach how pathetic you all are being by just giving up when the game is already complete.  I can understand being discouraged if it was only 50% done.  But I just can't comprehend how any of you went into this not expecting to have to release it against these corporate fatcats wishes in the first place.  You put so much work into it, grow a pair and release it already. 

Apologies for the anger in my words, and I realize I don't deserve a say in this manner, but I just couldn't stand by and watch this all happen without at least saying something about how ridiculous you are all being.  If I developed a cure for cancer but I would face litigation if I were to release it due to many pharmaceutical companies going out of business you can bet your ass there would be instructions for the cure in every person's inbox as soon as humanly possible.

I am too and sometimes I feel like I just want give up, but I just have to tell myself, each day we are getting closer. Each day the finish line is coming closer and when the hard race over that victory lap will be so sweet. This is my same philosophy for getting through college

Well I read through the C&D forum.  All that I read was "blah blah blah we can't do this because it will come back to us and we will be sued"  Whenever someone asked "Why don't you change the names in the dialogue and some images so it's not linked to KQ" no one answers them.  Honestly, if you guys just never sent this to them for approval in the first place it probably would have gone unnoticed.  Petitions are not going to save this game, petitions are a joke, yet I still filled one out anyway.  I wish I was running this project, I would have released it already.  The only reason exclaimed as to why it can't be "leaked" is because supposedly it will come right back at you saying you were just being defiant because of the C&D.  So.. a disgruntled tester leaked it after hearing the C&D news, not that ridiculous.  Come on.  Let me be that disgruntled tester.  The whole world will be enjoying KQIX: Every Cloak Has a Silver Lining by morning.  Honestly part of me believes you all enjoyed the "secret exclusive TSL society" for so long you don't want to give that up by letting everyone enjoy it.

This is very different.  Before it was because you had the same exact name.  That was essentially all you had to change.  You were acting like your game was apart of their franchise.  I don't blame them for making you change it.  But then they were reasonable and only requested that you change the name and that you could continue.  Activision is not understanding.  If you made a game that just remotely made mention of one of their games through an obscure inside joke of a reference on the back of an NPC's t-shirt that can only be seen for half a millisecond they would send you a C&D.  TSL is not coming back from this if they are going to curl up into the fetal position from a single letter.  Hell, from seeing how easy TSL caves, I bet I could have spoofed an email from "lawyer_guy12@aol.com" and said "no more tsl, we sue u!!" and they would have thrown in the cards.

This is one of those "well why don't you do this, this, and this" situations and my response to this is, "if you think you can do it so well, go make your own game."  

It's really simple as that.  These people have put all kinds of time, money, heart, and soul into this game and you bashing them is not going to help.

on another note, you must not have read the whole thread.  There is great information in there.  Like why would they do this with the risk.  (Sidenote: I am not on the team.  I am just a big fan)
So what?  Activision is evil but there are tons of possibilities.  I mean, that kotik dude could get fired.  I mean he is horrible.  Not just to TSL either.  Google him, you will find lots of stuff.  I don't see a reason not to try to stand up for TSL.   Being negative never turns out well.

Thanks rider.  That was really useful.  I'm not bashing them, I'm being inquisitive as to their nature.  It's beyond me.  And my point is exactly that, they put time, money, heart and soul into the game and cave without the slightest effort.  And I'll tell you one thing, If I did go make my own game, I wouldn't get thousands of people's hopes up and disappoint them because of some C&D letter.  I'd laugh in their faces and release it that day.  But then again, I would have released it without attempting to get it approved.  Just "sell" the game to someone in the netherlands, let them own it and host it for all to dl.  There are a million perfectly acceptable and safe routes to take.  And my inquisitions could help, because maybe it will open their eyes.  I imagine after the denial wears off in about a year and acceptance finally kicks that petitions will not do anything and that the project is finished yet will never be released that someone in the group will finally just release it.

You are the type of person I try to avoid because I loose composure. However this is a time when I am going to give you a piece of my mind.

They sent the game to Activision because they were under and order by Vivindi who was bought by Activision. The fan licence was then place in Activisions care and many hoped they would honor a past agreement. POS did everything right, no matter what you say, they followed through with their end of the bargin.

On the note of petitions, they worked 5 years ago and they at least open someones eyes to how much anger is out their. They are receiving bad press all the time and this one isn't going away because of the Save TSL Movement, which I am a proud member of. We will continue to do what is necessary to get Activisions attention, if you don't want to help that is fine.

The part about leaking the game, is a cheaters way out of a problem and you aren't even making it better, the problem still exists you just took a short cut and in the end it will bite you. Activision is waiting to see what everyone does. I work for a lawyer and he is not cheap, no lawyer is cheap and the workers at POS are not getting paid for this game. It took so long because they have a regular 9-5 job and I bet they don't make enough to cover the court costs in which they could still lose.

You like to do all the big talk but in the end, if you were faced with a huge lawsuit or an attempt to make corrections or persuade another to change their mind, what would you do, huh? I fully support TSL's handling of the situation and we don't need you and your pessimistic attitude flooding the team who feels just as bad about this as the rest of us.

Last note, they kept everything secret because what the use of telling the story to everyone and then making a game. It has been the curiosity that has fueled my passion for  this game for a while now.

Yea you didn't read the thread in it's entirety.  I spent about 5 minutes scanning the thread and came up with this little tidbit:

I have read the whole thing a lot of times.  I am tired and don't feel like it right now, but you can find great answers to all your questions in the thread.  Search erpys recent posts -- he has made some good points that answer your questions.
Anyway...  if you fight against the team, you aren't helping, and it is unwise if you  want TSL relesed.

Oh and I wish you were running the project.  That way you could get slapped with the nice big lawsuit for not abiding by a C&D.  The whole topic of "leaking" was also discussed into the ground in the C&D thread (most notably on Page 7 onwards).

And as for your argument about just releasing the game instead of showing Activision first, here's a news flash.  The fan license the team has from Vivendi stipulated Vivendi had final approval rights before the game was released.  If POS had simply released the game... they would have been in breach of their license with Vivendi (which was acquired by Activision).  

So either way you cut it... lawsuit city.  Like I said though... a pity you weren't running the project.  Maybe a big legal battle would have taught you the value of thinking before you act (a lesson you clearly didn't learn from playing King's Quest).

Hmm, sorry I missed that.  There was 30 pages, I scanned looking for that kind of information skipping the consistent "I'm so sad, etc." posts.  And waltzdancing, I have been in situations dealing with lawsuits.  My company pushes the "grey area" all the time.  We just aren't scared of lawyers.  Do what everyone else does.  Accept donations, add advertisements, charge for the game, etc.  And I was expecting a piece of your mind, you didn't loose composure at all :)

I 100% agree.  Seriously, no matter what happened, if this game in any way got released at this point and time, the team would get sued, and no one wants that.

As someone whose known people who've worked on fan films, they often get the same kind of complains about not releasing it because of a higher corporatins wishes.  Their response is often that it would irreveribly damge any possible chances of future fan films to get released.

Right now, if the TSL team can work something out with Activision, we will get to see the game, and possibly more.  If they just leaked it on the internet, we'd get the game, but zero hope of anything following it.

So for now, as they say, "fight the good fight."
