With the precursor of "I am not a lawyer or a cop or FBI agent or anything of the sort," if McAdams is alive at the end of the episode, he mentions that there'll be an investigation and he'll do what he can for Erica but can't make any promises on her getting her job back. (To which she says thanks, but I'm quitting anyways.) That's about as much as we touch on that here--but from a wide-angle view, IMO, it was a horrible accident under stressful circumstances to say the least. Erica just realized that she'd let the Cain Killer go (and of this there is actual proof that's unrelated to her visions), the lights were flickering out, and the same message left for her on the tomb where her brother was killed was written in blood on the wall in front of her. She hears a noise behind her and reacts--tragically, it isn't the bad guy but her partner.
He dies, but what happened was a moment of poor judgement in a bad and dangerous situation and far from intentional. "Friendly fire", if you will, but that's how that plays out to me, at least. A case could be made for manslaughter, certainly, but if that comes up it would happen in the next game anyways, not this one, and only if that were part of the story we wanted to tell.

Admittedly there Is one way that I can think of John being still alive Is that they're gonna send him on an undercover mission and if people thinks he's dead then that would help him.
