Actually it's spelled "Jeopardy"  ::) but it means you can't be tried for the same crime twice. Under US law that means that no matter what new evidence is brought up after the trial is over, you still can't be tried more than once after you are found innocent.  I think it even means no new evidence can be brought up after the jury is sworn in, but don't quote me on that.  In most other nations a second trial can begin if "compelling" new evidence is found.  The UK changed away in 2003.    IIRC India of all nations is only large nation to follow the US model, but don't quote me on that either.  ::)

Raforever

So THATS why trials take so long :P

I don't think it adds to trial's length.  I'm not aware of anyone dragging a trial out so that more evidence can be found, that's why they wait until the investigation is over before they have trial.  ;D  It was originally meant to stop the government (or anyone else) from wearing a person out with legal fees and time in court by bringing the same charge against them again and again.   :) But US law is pretty differant from most other countries in that area, so I have no idea what things are like in Brazil.

One word: slow :P

On that case, at that moment, the trial actually never started, due to a lack of evidence. There was nobody find guilty nor innocent. IIRC, there wasn't even a Jury yet. But anyway, the TSL Court is an international one, and in that one when 'compelling' new evidence is released, a trial can be reopened, even when it's already concluded (which that one wasn't). That's the Court's prerogative. It's strange in the US even new compelling evidence won't be admitted as new evidence to repopen the court. What if such new evidence shows the accused, who was found guilty, undeniably innocent (which would be what the accused said all along)? (*thinks there's some grammatical error in this last sentence*)

Actually I read

QuoteCase dismissed due to lack of evidence. The Court is now retiring.

back on page three.  But whatever, I have no knowledge of TSL jurisprudence.  ::)

QuoteWhat if such new evidence shows the accused, who was found guilty, undeniably innocent (which would be what the accused said all along)?

I'm pretty sure that retrials are allowed in that case.  I'm not a lawyer but I recall some recent cases where new DNA testing technologies proved people innocent and they were released so I guess it must be allowed.  ;D The US system of justice is designed to make it very hard to convict anyone.

Pacman928

if there's jeopardy, can we play it?

Can  I bring charges against  Yonkey alias Neil Rodrigues? He committed a serious crime..... He didn't hugged his teddy bear enough. Now his teddy bear is suffering terrible psychological troubles like not sleeping well and feeling lonely.
