That's why I'm saying it's interesting nonetheless, I sort of understand what you mean because it's true, that's why they all decided to go with this, because the lack of use/production or such in so long, also I don't believe they thought this would be such a hit, the team just worked towards the best they could within all they wanted and all they had, so obviously I do believe it all became bigger than anyone thought it would, that's probably why VU waited for so long, they understood that it was serious (regardless of the time of production) and they finally gave the C&D. Most of the posters are just randomly making statements asuming things, which is probably some of them just go into other topics so easily, I guess.

Also what they say it's right, the IP is to "protect" and avoid situations like this otherwise everyone would be doing as they want and what would be the point of having IP anyhow? the problem is, as you said, they make it a solid rule without any circumstances to be considered, which is also not feasible whatsoever, if law worked that way then lawyers would not exist and whoever who did a crime would get the same time inside jail and whatnot, they are going sideways big time trying to make a point but overall the conversation goes around not only IP but also business-matters which is why I liked reading it.

Hmm...do you really think that it may that Vivendi did this all becuase they wanted the fans attention? That they wanted the fans to notice them even if it was worth their reputation? That there was no specific reason for stop production on KQ9? Just a thought, a terrible one, but a thought none the less.

They own all of it, so they could can do as they want with it :P I seriously, don't know why they took so long to provide the letter, but, as I said, my guess is as good as anyone's, I just believe they finally saw we were for real so it was the right time for it. that's all :(

As such, I'll do my part (such as it is), to try and change this.

Being the owner of my own company (poor as it is =/), we will institute this policy (once the final version is drafted).

Which is basically to say:

If it has been about 10 years since the last game, and the IP owner cannot produce a 'good' reason against it, then the IP should be open for Fan games (again it's all in the policy I wrote).

clearly the issue is the monolithic business entitiy, they only know one trick and are unwilling to bend.

I will also write VU and express my feelings (if somone has a mailing address?)

I will need to be carefuly not to triger slander or libel, but certainly, we haven't been and won't be endorsing VU or EA for that matter.

As the owner of your company (as small as it is) you can pretty much go around your copyrights as you'd like, I believe, regardless of what laws would say, you're completly free to allow or shut down a fan-production if needed, I guess :).

Maybe it has been said before because i haven't read every single post on here (I wonder how many people have actually read every single post in this thread, hehe)...but I wonder what Roberta Williams thinks about all of this (assuming she has any clue).  We need to contact her and get her support, lol.  I assume she has no rights where KQ is concerned anymore, but still, it is her baby.  Wouldn't that be awesome?  Roberta stepping up to the plate for POS and talking to Vivendi on their behalf.  If you are out there and listening Roberta, help us out!!! :)

I believe the team hasn't contacted Roberta, but they know about it (Ken and Roberta) because they posted about it on their forums. Now, if I could only remember in which page was the link to their forum :P... I'd show you, really :P

The KQ9 team have only themselves to blame. They should have known. They could have made the same game without stealing someone else's IP. They can still continue to make the same game and have it be a tribute or parody of KQ. No need to steal the IP.

How were they not expecting this to happen? The same thing happened with the Chrono Trigger remake which, after having gigantic amounts of work put into it, was shut down by squaresoft. From what I understand, in some ways it makes sense that those who hold the IP would close the game down. If the game is really good, people might say 'well why the heck did Vivendi not make a game this good then? What idiots', or in the case it really is quite terrible, a lot of people will assume it was made by Vivendi, giving them bad coverage when it is not even their release.
